• Gallery 7 as a brand name is a registered company as per the Shop and Establishment Act.

 

• The Gallery 7 logo and brand name is a registered trademark.

 

• Gallery 7 may be affiliated with and/or may outsource services to different vendors in order to enhance user satisfaction. Gallery 7 shall not be held accountable or liable for any of these third party vendors, in any matter whatsoever.

 

• All and any user information provided at the time of registration shall be secured by Gallery 7 and shall not be shared with any individual or third party unless consented by the user. In the event that a law enforcement agency or government agency may need to exercise their legal authority and require disclosure of said user’s details, Gallery 7 will be forced to oblige.

 

• Images and data, submitted to Gallery 7 by artists, sellers, buyers or any such person related to the arts, in relation to artworks (paintings, prints, sculptures, photographs, etc.) maybe edited, reformatted, reproduced, published and circulated both online and offline as Gallery 7 deems fit.

 

• Text submitted by art critics, writers and those in the literary field maybe re-edited and published online and offline as per the requirement of Gallery 7.

 

• No user shall be granted authorisation to download images, data or any other information from the Gallery 7 website for the use of sale, display, circulation, mass communication, reproduction, publication or for any other means.

 

• All deliveries of artworks shall only be made after total receipt of payment. International deliveries may take 12 to 18 working days (by air) after realisation of payment and maybe subject to delay due to government and custom regulations at either port.

 

• Deliveries of artworks within India may take 7 to 14 working days (by air/road) after realisation of payment and maybe subject to delay due to interstate authorities during transit.

 

• Deliveries of artworks within the city of Mumbai may take 4 to 7 working days after realisation of payment.

 

• Shipping rates charged on domestic and international shipments shall be based on volumetric weight, actual weight, destination, fuel surcharge, and taxes as per third party vendor rates inclusive of gallery fees.

 

• All artworks may not be physically present at Gallery 7 and may come from an alternate location, which may be in any part of the world.

 

• Packing rates shall be charged based on the size and medium of the artwork as well as the packing material and the labour required, rates inclusive of gallery fees.

 

• Should the buyer wish to purchase transit/offsite insurance (local or international) through Gallery 7. There will be an additional 1% insurance fee charged on the artwork. Gallery 7 strongly recommends the buyer to insure all artworks. Any claims of damage or loss should be settled directly with the shipping or insurance company. Gallery 7 will not be liable but will assist with the same.

 

• Artists and sellers wishing to insure artworks kept on consignment, will be charged a 1% insurance fee at the time of consignment which they must opt for. In the absence of insurance, Gallery 7 will not be held liable in the event of unavoidable damage or loss to consigned artworks held on the premises.

 

• Artworks listed on the website that maybe unframed or in their original state of framing will be delivered as they are.

 

• Cost of shipping, packing, framing, insurance and any other additional charge shall be borne by the buyer and will be inclusive of gallery fees.

 

• Artworks given on consignment by artists or sellers must be sent framed to Gallery 7. Gallery 7 may however reframe these artworks if deemed necessary to increase their saleability. Reframing charges will be reimbursed to Gallery 7 by the artist or seller.

 

• Large format works will be shipped in a roll (unframed and un-stretched) in cylindrical PVC tubes. Artworks will be delivered to the buyer through a well-known and reliable courier service. In the event that the artwork received by the buyer is in a damaged condition (damage to the frame is not covered by the insurance company), the said damage should immediately be noted on both copies of the airway bill and Gallery 7 must be informed within 12 hours of receiving the artwork via an email correspondence and close-up images of the said damage, with a copy of the airway bill enclosed. Gallery 7 will not be held liable but will assist in the claim process if there is an insurance policy in place.

 

• All duties, taxes and charges (customs, government or others) applied on the artwork entering a foreign country shall be borne solely by the buyer.

 

• Any sale that takes place within India is subject to GST at 12% on the sale value.

 

• Full payment must be made to Gallery 7 in advance, on all sale of artwork. No discounts, refunds or returns of artworks will be issued or accepted.

 

• Gallery 7 reserves the right to cancel a sale without prior notice to the buyer.

 

• Works depicted on Gallery 7’s website are close to their original form, however, there may be some variation in colour, size and shade.

 

• The frames on the paintings displayed on the website are only for representational purposes and may not be the actual frames provided with the paintings.

 

• Some images of artists and certain content on the website may be adapted from third party websites purely for informative purposes and not financial gain.

 

• Post receipt of payment, a Gallery 7 Certificate of Authenticity, an invoice, an Artist’s Certificate of Authenticity (if available) and any other supporting documents in relation to the artwork will be issued along with the work.

 

• All artwork will be sold in its current condition. If restoration is required, the cost shall be borne by the buyer. Condition reports can be provided on the buyer’s request.

 

• Prices indicated on Gallery 7’s website are in Indian rupees (INR) and US dollars (USD) and are not inclusive of prevailing taxes such as GST. Applicable taxes will be reflected on the invoice.

 

• GST is not applicable on shipments leaving the country, provided the goods are exported within RBI permitted time limit, however, shipping, packing and insurance charges and gallery fees are applicable.

 

• In accordance with the Antiquities and Art Treasures Act, 1972, Gallery 7 shall not participate in the exporting of national treasures.

 

• The foreign currency exchange rate for the artworks is made as per prevailing exchange rate and the price of the artwork has been indicated accordingly for the ease of reference and may not necessarily reflect the exact exchange rate used for the final invoice.

 

• Invoicing for international sales will be made in USD.

 

• Modes of payment accepted by Gallery 7:

 

- Wire transfer (International and Domestic) (An MT copy / transaction copy is required for all payments made via wire transfer)

 

- Demand draft (Domestic payments)

 

- Credit card / Debit card  (International and Domestic) [Payments will only be accepted at Gallery 7, Mumbai (Offline)] 
 

• All payments must be made as per the invoice provided by Gallery 7 at the time of confirmation (INR/USD). Any bank charge, processing fees or any other charges/fees must be absorbed & borne by the buyer. Any shortfall needs to be paid with 7 working days.
• All payments must be made within 7 days of confirmation. Credit / Debit card payments and bank transfers may be subject to additional charges, which must be borne by the buyer in addition to the cost of the artwork. The buyer shall confirm that all credit / debit card details are true and accurate and the buyer will be held liable for any charge backs in relation to credit card payments.

 

• On confirming an artwork, a buyer is committed to pay and acquire the said artwork.

 

• Gallery 7 guarantees the authenticity of all works sold on its website and provides the buyer with a Certificate of Authenticity. Gallery 7 ensures that the provenance and supporting documents on the work are impeccable. In the unlikely event that within a period of one month from the date of sale, the artwork is proven to be inauthentic to Gallery 7’s satisfaction, Gallery 7 will refund the entire amount within 15 working days. The artwork must be returned in its original condition, accompanied by the original documentation by the initial buyer of the work.

 

• Once an artwork has been purchased from Gallery 7, the buyer agrees to collect it from the gallery within 15 days from the date of purchase, after which demurrage charges of Rs. 1,000/- shall be charged per day. GST will be applicable on the same.

 

• Sellers, artists and consignees of artworks must collect their works within 7 days of being notified by Gallery 7, the cost of which will be borne by the artist or seller. Gallery 7 shall not be liable for any damages caused to the artwork.

 

• Gallery 7 reserves the right to grant, refuse or to delete a user without any prior notice.

 

• Gallery 7, its owners, licensees, affiliates, subsidiaries, agents and employees are indemnified from any claim or demand made by any third party or penalty imposed as a result of a client’s breach of these Terms and Conditions, a client’s violation of any law or regulation or a client’s violation of the rights of a third party.

 

• Gallery 7 reserves the right to change, alter or delete any of the Terms and Conditions.

 

• In the event of a dispute, Gallery 7’s decision shall be final and binding.

 

• The Gallery 7 Terms and Conditions shall be governed by, interpreted and construed in accordance with Indian laws.

 

• The place of jurisdiction shall be exclusively in Mumbai, India.
